1. Introduction and Acceptance

Welcome to Glocal Turkey ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Glocal Turkey website located at https://glocalturkey.org and all associated services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform. Your continued use of the Platform constitutes acceptance of any modifications to these Terms.

Glocal Turkey is registered as Glocal Turkey Travel Services, located at Barbaros Mahallesi, Begonya Sokak No:15/A, 34746 Atasehir, Istanbul, Turkey.

2. Platform Role and Service Model

Glocal Turkey operates exclusively as an intermediary platform connecting international travelers with verified local service providers in Turkey. We are NOT a direct supplier of travel services.

2.1 Our Role

We provide a technology platform that enables you to:

• Search and compare offerings from licensed local service providers
• Access third-party booking widgets and affiliate partner platforms
• Make informed decisions about travel services in Turkey
• Connect directly with service providers for bookings

2.2 Direct Contractual Relationships

All service agreements — including but not limited to car rental contracts, hotel reservations, flight bookings, insurance policies, eSIM purchases, and airport transfer arrangements — are concluded directly between you (the customer) and the respective service provider. Glocal Turkey is not a party to these contracts.

2.3 Services Covered

The Platform facilitates connections for the following service categories in Turkey:

• Car Rental: Vehicle rentals in cities and airports across Turkey through LocalRent widget integration
• Travel eSIM: Mobile data connectivity solutions for Turkey through partner providers
• Travel Insurance: Coverage options for travelers visiting Turkey
• Airport Transfers: Ground transportation from Turkish airports to destinations
• Flights: Air travel to and within Turkey
• Hotels: Accommodation options throughout Turkey

3. User Obligations and Conduct

3.1 Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts.

3.2 Accurate Information

You agree to provide accurate, current, and complete information when using the Platform and interacting with service providers. You are responsible for maintaining the accuracy of any information you submit.

3.3 Prohibited Uses

You agree NOT to:

• Use the Platform for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any portion of the Platform
• Interfere with or disrupt the Platform's operation or servers
• Use automated systems (bots, scrapers) to access the Platform without permission
• Impersonate any person or entity or misrepresent your affiliation
• Transmit viruses, malware, or other harmful code
• Collect or harvest personal information of other users
• Use the Platform to compete with or replicate our business model

4. Booking Process and Third-Party Widgets

4.1 Third-Party Booking Widgets

The Platform integrates booking widgets and tools provided by third-party service providers and affiliate partners. These widgets allow you to search availability, compare prices, and initiate bookings.

4.2 External Processing

When you proceed with a booking through a widget or affiliate link, you are redirected to the service provider's or partner's platform. The booking process, payment collection, and contract formation occur directly on their system, not on Glocal Turkey's platform.

4.3 Provider Terms Apply

Each service provider has its own terms and conditions, cancellation policies, privacy policies, and pricing structures. You must review and accept the provider's terms before completing any booking. Glocal Turkey is not responsible for the terms, policies, or practices of third-party providers.

5. Pricing, Payments, and Fees

5.1 No Direct Charges

Glocal Turkey does not charge users directly for accessing or using the Platform. Our Platform is free for travelers.

5.2 Provider Pricing

All prices, rates, deposits, insurance costs, and fees are determined by the individual service providers. Prices displayed through widgets or affiliate links are provided by those third parties and may change without notice.

5.3 Currency and Conversion

Prices may be displayed in various currencies depending on the service provider. Currency conversion rates, international transaction fees, and foreign exchange charges are determined by your payment method provider and the service provider.

5.4 Payment Processing

All payments are processed directly by the service provider or their designated payment processor. Glocal Turkey does not collect, process, or store payment information.

5.5 Affiliate Commissions

Glocal Turkey may earn affiliate commissions from service providers when you complete bookings through our Platform. These commissions do not increase the price you pay and are paid by the service provider.

6. Cancellations, Refunds, and Modifications

6.1 Provider Policies Govern

All cancellation policies, refund eligibility, modification procedures, and associated fees are determined solely by the service provider with whom you have contracted.

6.2 Direct Communication Required

To cancel, modify, or request refunds for any booking, you must contact the service provider directly. Glocal Turkey cannot process cancellations or refunds on behalf of providers.

6.3 No Refund Guarantee

Glocal Turkey does not guarantee that any service provider will offer refunds or accept cancellations. Refund eligibility depends entirely on the provider's terms and the specific circumstances of your booking.

7. Car Rental Specific Terms

7.1 LocalRent Integration

Car rental services on the Platform are facilitated through LocalRent's booking widget. When you book a car rental, you enter into a direct contract with the local car rental company selected through the widget.

7.2 Driver Requirements

Car rental companies in Turkey typically require drivers to:

• Hold a valid driver's license for at least one year
• Meet minimum age requirements (usually 21-25 years, varying by company and vehicle class)
• Possess an International Driving Permit (IDP) if license is not in Latin alphabet
• Present a valid credit card in the driver's name for deposit

7.3 Vehicle Condition Documentation

You are responsible for thoroughly inspecting the rental vehicle before accepting it and documenting any pre-existing damage in the rental agreement. Failure to document damage may result in you being held liable for that damage upon return.

7.4 Insurance and Liability

Insurance coverage options, deductibles, liability limits, and additional driver fees are determined by the car rental company. Review all insurance terms carefully before signing the rental agreement.

7.5 Cross-Border Travel

If you plan to drive a rental vehicle across international borders, you must obtain explicit permission from the rental company. Unauthorized cross-border travel may void your insurance and result in significant penalties.

8. Travel Insurance Specific Terms

8.1 Third-Party Insurance Products

Travel insurance products promoted on the Platform are underwritten and provided by licensed insurance companies. Glocal Turkey is not an insurance provider and does not underwrite any insurance policies.

8.2 Policy Review Obligation

You must carefully review all policy documents, coverage limits, exclusions, claim procedures, and terms before purchasing travel insurance. Insurance coverage varies significantly between providers and policy types.

8.3 Claims Process

All insurance claims must be filed directly with the insurance company according to their claims procedures. Glocal Turkey does not process insurance claims or determine claim eligibility.

9. Intellectual Property Rights

9.1 Platform Content Ownership

All content on the Platform, including but not limited to text, graphics, logos, images, design elements, software code, and compilations, is owned by Glocal Turkey or our licensors and is protected by Turkish and international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any content from the Platform without our prior written consent, except for temporary storage in RAM incidental to normal browsing.

9.4 Trademarks

The name "Glocal Turkey," our logo, and all related names, logos, and service marks are trademarks of Glocal Turkey. You may not use these marks without our prior written permission.

10. Disclaimers and Limitations of Liability

10.1 Platform Provided "As Is"

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10.2 No Warranty of Accuracy

While we strive to provide accurate information, Glocal Turkey does not warrant that the information on the Platform is accurate, complete, reliable, current, or error-free. Prices, availability, and service details are provided by third parties and may change without notice.

10.3 Third-Party Service Provider Disclaimer

Glocal Turkey is not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party service provider, or for any personal injuries, death, property damage, or other damages or expenses resulting from your interaction with service providers.

10.4 Limitation of Liability

To the maximum extent permitted by applicable law, Glocal Turkey, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Platform
• Any conduct or content of any third party on the Platform
• Any content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content
• Bookings made through service provider platforms or widgets
• Disputes with service providers

10.5 Maximum Liability Cap

In no event shall Glocal Turkey's total liability to you for all damages, losses, and causes of action exceed fifty Turkish Lira (50 TRY) or equivalent.

10.6 Jurisdiction-Specific Rights

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Glocal Turkey, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Platform
• Your bookings or interactions with service providers
• Your violation of any rights of another person or entity
• Your violation of any applicable law or regulation

The Platform contains links to third-party websites, including service provider platforms and affiliate partner sites. These links are provided for your convenience only. Glocal Turkey does not control, endorse, or assume responsibility for the content, privacy policies, or practices of any third-party websites.

Your access and use of such third-party websites is at your own risk, and you should review the terms and policies of any third-party website before using it or providing any information.

13. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.

When you interact with service provider widgets or are redirected to provider platforms, those third parties' privacy policies apply to the information you provide to them.

14. Geographic Scope and Governing Law

14.1 Turkey-Focused Services

The Platform is specifically designed to connect travelers with service providers operating in Turkey. While users from any country may access the Platform, the services facilitated are for travel within Turkey.

14.2 Governing Law

These Terms and your use of the Platform shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law principles.

14.3 Jurisdiction

Any disputes arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

15. Dispute Resolution

15.1 Direct Negotiation

If you have any dispute with Glocal Turkey, you agree to first contact us at [email protected] and attempt to resolve the dispute informally by negotiating in good faith.

15.2 Provider Disputes

Disputes with service providers must be resolved directly with those providers. Glocal Turkey is not obligated to mediate or resolve disputes between users and service providers.

15.3 Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under applicable Turkish consumer protection laws.

16. Modifications to Terms

Glocal Turkey reserves the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this page and, where appropriate, by posting a notice on the Platform or sending an email to registered users.

Your continued use of the Platform after any modification to these Terms constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform.

17. Termination

17.1 Termination by Glocal Turkey

We reserve the right to terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

17.2 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be made enforceable, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Glocal Turkey regarding your use of the Platform and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter.

20. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may freely assign or transfer these Terms without restriction.

22. Force Majeure

Glocal Turkey shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, government actions, internet outages, or failures of third-party service providers.

23. Language

These Terms are written in English. Any translations provided are for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.
